Information Notice on the Protection of Personal Data for Suppliers and/or Customers
As Nadir Metal Rafineri San. ve Tic. A.Ş. (“Nadir Metal” or the “Company”), acting in the capacity of the “Data Controller”, we are dedicated to processing, storage, and deletion of personal data with the highest level of care, in accordance with the Personal Data Protection Law No. 6698 (“Law”), secondary regulations (including regulations, communiqués, circulars), and decisions issued by the Personal Data Protection Authority.
This privacy notice has been prepared to inform you that, as Nadir Metal, we will process your personal data as outlined below and within the boundaries established by the applicable legislation.
- Information Regarding the Data Controller
Nadir Metal Rafineri San. ve Tic. A.Ş., registered with the Istanbul Trade Registry Office under registration number 307305-0 and MERSIS number 0627037074500012, operating at the address “Yenibosna Merkez Mahallesi Kuyumcular Sok. Kuyumcukent – Vizyonpark Sitesi C Atölye Apt. No:4/1101 Bahçelievler, Istanbul / Turkey,” is the data controller within the scope of the law.
- Purposes of Processing Personal Data
Your personal data is processed by Nadir Metal within the limits specified by the Law, in compliance with the principles of lawfulness, fairness, and relevance, and always in a limited and proportional manner for the following purposes:
- To fulfill our obligations under the Personal Data Protection Law No. 6698 and the secondary regulations issued under this Law,
- To fulfill our obligations under the Law on the Protection of the Value of Turkish Currency No. 1567 and the secondary regulations issued under this Law,
- To fulfill our obligations under the Law on the Prevention of Laundering Proceeds of Crime No. 5549 and the secondary regulations issued under this Law,
- To fulfill our obligations under the Law on the Prevention of Financing of Terrorism No. 6415 and the secondary regulations issued under this Law,
- To fulfill our obligations under the Law on the Prevention of Financing the Proliferation of Weapons of Mass Destruction No. 7262 and the secondary regulations issued under this Law,
- To conduct commercial activities and plan business strategies,
- To ensure the Company’s legal, technical, commercial, and workplace safety,
- To carry out sales and marketing activities for products and services,
- To maintain communication with customers,
- To manage customer relations and ensure the accuracy and currency of contact information,
- To ensure customer satisfaction and address their needs,
- To plan and execute customer satisfaction and corporate communication activities,
- To conduct necessary activities to provide relevant persons with access to products and services,
- To carry out customer acquisition activities,
- To provide information to third parties involved in business relations as part of commercial activities,
- To resolve requests, questions, suggestions, and complaints, and to implement preventive measures,
- To comply with the legal obligations under laws such as the Law on Consumer Protection, the Law on Regulation of Retail Trade, and the Law on Regulation of Electronic Commerce, among others,
- To ensure compliance with data retention obligations stipulated by legislation,
- To provide information/documents to authorized individuals or entities as required by legal obligations,
- To conduct all official correspondence,
- To respond to inquiries from data subjects in accordance with the legislation.
- Transfer of Personal Data
Your personal data may be transferred, within the scope of the purposes mentioned above and in compliance with the conditions specified in Articles 8 and 9 of the Law, to public authorities authorized by law, judicial and administrative bodies, private legal and natural persons permitted under applicable legislation, institutions and organizations authorized to audit the Company, payment institutions contracted for fulfilling payment and financial obligations, business partners providing services or collaborating with the Company to conduct and develop its activities, and, when necessary, to the Company’s suppliers. Such transfers will only be made to the extent required for achieving the specified purposes.
- Methods and Legal Grounds for Collecting Personel Data
Your personal data may be collected directly from the data subject and/or third parties through tools such as emails, application forms, phone calls, websites, forms, and records kept in physical formats, as well as via written or verbal communication channels, in both written and electronic environments.
This data is processed based on the legal grounds specified in Article 5, Paragraph 2 of the Law, including: (a) It is explicitly stipulated in the law; (c) It is necessary to process the personal data of the parties to a contract, provided that it is directly related to the establishment or performance of the contract; (ç) It is necessary for the data controller to fulfill their legal obligation; (e) It is mandatory for the establishment, exercise, or protection of a right; (f) It is necessary for the legitimate interests of the data controller, provided that it does not violate the fundamental rights and freedoms of the data subject.
- Rights of Data Subjects Under the Law
Pursuant to Article 11 of the Law, you may apply to Nadir Metal at any time to:
- Learn whether your personal data is being processed,
- Request information regarding the processing of your personal data,
- Learn the purpose of processing your personal data and whether it is being used in accordance with its intended purpose,
- Learn the third parties, either domestic or abroad, with whom your personal data has been shared,
- Request correction of your personal data if it has been processed incompletely or inaccurately,
- Request the deletion or destruction of your personal data under the conditions specified in Article 7 of the Law,
- Request notification to third parties to whom your personal data has been transferred regarding the actions carried out under subparagraphs (d) and (e) of Article 11 of the Law,
- Object to any result arising against you due to the exclusive analysis of your personal data through automated systems,
- Request compensation if you suffer damage due to the unlawful processing of your personal data.
We hereby inform you of these rights you are entitled to under the Law.
Applications made to Nadir Metal for these purposes can be submitted in accordance with the “Communiqué on the Principles and Procedures for the Application to the Data Controller” using one of the following methods:
- After completing the form available on the Company’s website, you can deliver a wet-signed copy in person or via a notary to the address: “Akçaburgaz Mh. 3114 Sokak No:6 34522 Esenyurt, Istanbul/Turkey.”
- After completing the form available on the Company’s website and signing it with your secure electronic signature under the Electronic Signature Law No. 5070, you can send the securely signed form via registered electronic mail (KEP) or email to kvkk@nadirmetal.com.tr.
- After completing and signing the form available on the Company’s website, you can send a copy of it via email to kvkk@nadirmetal.com.tr or the KEP address, using the email address registered in the Company’s systems.
These methods can be used to submit your applications.
In your applications, it is mandatory pursuant to the “Communiqué on the Principles and Procedures for Application to the Data Controller” to include your full name, signature, nationality (for foreign nationals), Turkish ID number/passport number, residential or workplace address, email address, telephone and fax number, and the subject of your request. Applications that do not contain these required elements will be rejected by Nadir Metal.
The requests included in your application will be finalized as soon as possible and no later than 30 (thirty) days from the date of receipt, depending on the nature of the request.
Nadir Metal reserves the right to make changes to this notice at any time, due to reasons arising from the Law, secondary regulations, or decisions of the Board. Any changes to this disclosure text, as well as the updated version, will become effective immediately as of the date they are communicated to you.
